Common Questions About Yamhill County Deeds
The Yamhill County Clerk office gets many questions about deed records. Here are some of the most common ones and their answers based on the office FAQ.
If you want to change the names on your property, a new deed must be recorded with the Yamhill County Clerk. The office suggests you talk to a lawyer before you transfer property. They cannot give legal advice or provide blank forms. If you pay off a loan on your property, you will not get a new deed. Instead, your lender should file a Satisfaction of Mortgage or a Deed of Reconveyance showing the loan is paid. This is a separate document from the deed itself.
When a spouse passes away, the Yamhill County Clerk recommends consulting an attorney before recording a death certificate. Recording a death certificate removes the name from the tax roll but does not create a new deed. If you need a copy of an existing deed, contact the office by email at clerk@yamhillcounty.gov, by phone, or in person. Copy fees apply. The clerk is prohibited from helping fill out forms, suggesting which form to use, or giving legal advice about deed records in Yamhill County.
Public Access to Yamhill County Records
All deed records in Yamhill County are public under ORS 192. Any person can ask to see them. You do not need to be a party to the transaction or own the property. The clerk must respond to a written request within five business days.
Oregon follows a race-notice recording system under ORS 93.640. This means an unrecorded deed is void against a later buyer who pays value and records first without knowledge of the earlier transfer.
