Lane County Deed Recording Requirements

Deeds filed in Lane County must meet Oregon's format rules. As of January 1, 2024, HB 2029 changed the minimum font size for recorded documents from 8-point type to 10-point type. This applies to all deeds, mortgages, and other instruments filed in Lane County and statewide. The paper must be no more than 8.5 by 14 inches, and the weight must be at least 20 pounds.

The first page of any deed needs these items under ORS 205.234:

  • Names of the parties to the deed
  • Type of document being recorded
  • Return address for the recorded deed
  • True consideration paid for the property
  • Tax statement delivery information
  • Blank space on top right for recording label

If a deed lacks any of these items, the Lane County Clerk may require a cover sheet. The cover sheet fee is $5. A non-standard document adds $20. Oregon does not charge a transfer tax on property sales, so the recording fee is your only cost when filing a deed in Lane County.

The recording priority rule under ORS 93.640 protects buyers who record their deed first. If two people claim the same land in Lane County, the one who recorded in good faith and for value wins. This is why recording your deed as soon as possible matters.
